3. Purpose of processing, legal basis for processing and categories of data
In order to be able to provide the transport service, we need your personal data, in particular your name and surname, contact number and, in the case of recipients, also the place of delivery.
In relation to the above, we will process your personal data in order to execute the transport contract on the basis of art. 38 sections 1 and 2 and art. 50 of the law of 15 November 1984 on transport or the provision of art. 6 and 7 of the Convention on the Contract for the International Carriage of Goods by Road (CMR). We would also like to point out that if you are the recipient of the shipment, your personal data will be processed by us in your interest so that you can receive the ordered goods or shipment. In turn, the personal data of the employees of our contractors who will participate in the implementation of the transport service will be processed due to legitimate interests, namely the correct execution of the transport service (Article 6, paragraph 1, letters c), f), of the Regulation of the European Parliament and of the Council (EU) 2016/679).
Your data, to a limited extent, will also be used by our IT system - myRaben as part of the central database of recipients in relation to our legitimate interest, which is the consolidation of direct transport to a Recipient (Article 6, paragraph 1, letter f), of the European Parliament and Council Regulation (EU) 2016/679).
4. Data retention period
Your personal data will be kept until complaints that may be related to your person are prescribed or if the processing of personal data is necessary for the purpose of pursuing complaints or defending against the other party's complaints, which is the legitimate interest of the 'data administrator.
5. Data recipients
Our subcontractors, in particular carriers, as well as accounting, legal and IT companies, loss correctors, claims management contractors, auditors and consultants may have access to your data. Due to the use of data in the myRaben system, these may be visible to our customers when defining a potential recipient. At the same time, we guarantee that the disclosure of your data to the recipients indicated in no case will result in their processing contrary to the purpose indicated in the point. 3.
We inform you that we have also received your personal data from our client for the purpose of providing additional services. If you do not want us to process them, please contact your contractor who is the administrator of your personal data and request that they stop processing. At the same time, we would like to inform you that if you do not consent to the processing of your personal data and there is no other reason for legalization, we will not be able to provide additional services, which means, for example, that you will not receive notifications on the status of the shipment.
6. Your rights
We care about the security of your data and we also offer you the opportunity to exercise the rights relating to their processing. We remind you that you have the right to:
1) the right to access your data;
2) the right to rectify (correct) your data;
3) the right to request the deletion of data, the limitation of data processing, provided that the conditions established in the GDPR are met,
4) the right to object to the processing of your data due to your special situation - in cases where we process your data on the basis of our legitimate interest, unless we demonstrate the existence of valid legally valid reasons for the processing , ignoring your interests, rights and freedoms or reasons for establishing, investigating or defending claims. As part of the implementation of the right in question, it is possible, among other things, to oppose the processing of data in the central database of recipients myRaben, which will result in the exclusion of the visibility of the record for the customers of the system;
5) the right to data portability, i.e. the right to receive your personal data from us, in a structured, commonly used and machine-readable IT format. You can send this data to another data administrator or request to send it to another administrator, however, we will only do so if such transmission is technically possible;
6) the right to lodge a complaint with the supervisory authority.
7. Source of data origin
We have obtained your personal data from the principal of the transport service, i.e. your contractor, or from your employer in order to properly perform the transport service.
8. Transfer of data to a third country
Your personal data will be transferred to a third country only in the case of the provision of the international freight transport service outside the EEA by a foreign carrier outside the EEA. The transfer of data to a third country will take place pursuant to art. 49 sec. 1 lit. boc) GDPR, or where the transfer is necessary for the execution of the contract between the interested party and the data controller or for the execution of pre-contractual measures adopted at the request of the interested party or where the transfer is necessary for the conclusion or execution of the contract concluded in the interest of the interested party between the data controller and another natural or legal person.
